Cancellation of Removal or Deportation of a foreign citizen from the territory of United States America.
Cancellation of removal or deportation is a form of relief for those foreign nationals who are placed in removal or deportation proceedings in immigration courts and offices of United States Executive Office for Immigration Review.
This came as a replacement of “suspension of deportation” procedure which existed earlier. Two forms of “Cancellation of removal” procedures exist for “Lawful Permanent Residents” (LPR/Green card holders) and “Non-Lawful Permanent Residents” (non-LPR). The cancellation of removal makes them eligible for obtaining Lawful Permanent Residence/LPR/Green card or for retaining the LPR status.
Eligibility for Cancellation of removal is based on various factors like:
A) Continuous residence in U.S. for a long period (10 years or more for non-LPR and 7 years or more for LPR);
B) No prior criminal charges;
C) Certification of good moral character;
D) Establishment of the fact that his/her removal from U.S. can cause unbearable hardships to one or more lawful permanent resident or citizen of U.S.A. who is/are his/her immediate family member etc.
